Welcome to KROSSO. These Terms of Service ("Terms") govern your access to and use of krosso.in and all related content, features, and services (the "Services"), operated by Krosso ("KROSSO", "we", "us", "our"), a business based at Shop No. 208, Shepherd Royal, Laxmi Nagar, Link Road, Goregaon West, Mumbai – 400104, Maharashtra, India.
These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020. By visiting, browsing, or purchasing from krosso.in, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
KROSSO designs, manufactures, and sells its own products exclusively. We are not a marketplace or reseller — every product on this site is our own brand.
1. Eligibility and Account
You must be at least 18 years of age (the age of majority under the Indian Majority Act, 1875) to use the Services or place an order. If you are under 18, you may use the Services only under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
You are responsible for providing accurate, current, and complete information (name, contact details, billing and shipping address, payment details) when using the Services, and for maintaining the confidentiality of any account credentials. You are responsible for all activity under your account and may not transfer or share your account with any other person.
2. Our Products
We make every effort to accurately represent our products, including colours, fabric, and fit. Actual appearance may vary slightly from screen to screen due to device display settings. All product descriptions, pricing, and availability are subject to change at our discretion, and we reserve the right to discontinue or limit the quantity of any product at any time.
The designs, prints, and artwork displayed on this website are the exclusive intellectual property of Krosso and are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. Unauthorised copying, reproduction, or duplication of these designs is strictly prohibited and may result in legal action.
3. Orders and Acceptance
Placing an order is an offer to purchase, which we may accept or decline at our discretion (for example, in cases of suspected fraud, pricing errors, or stock unavailability). An order is confirmed only once we send you an order confirmation email. We will notify you by email or phone if we are unable to accept, or need to modify or cancel, your order.
Please review your order carefully before submitting. Cancellations after confirmation are handled per our Refund Policy. Products purchased on krosso.in are intended for your personal use and not for commercial resale.
4. Pricing, Taxes, and Payment
All prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise, in accordance with the Legal Metrology (Packaged Commodities) Rules, 2011. Shipping charges, if any, are shown separately at checkout before you complete payment.
Prices, discounts, and promotions may change without notice; the price applicable to your order is the price shown at the time you place it. We accept payment via the methods made available at checkout (including UPI, credit/debit cards, net banking, and wallets). You confirm that any payment information you provide is accurate and that you are authorised to use the payment method provided.
International orders: if we make the Services available for shipping outside India, orders may be billed in a different display currency, and you will be solely responsible for any customs duties, import taxes, or other charges levied by the destination country. Such orders are subject to the export and import laws of India and the destination country.
5. Shipping and Delivery
Shipping timelines and charges are set out in our Shipping Policy. Delivery estimates are our best-effort projections and not guaranteed delivery dates. We are not liable for delays caused by circumstances reasonably outside our control, including courier delays, customs processing (for international orders), or force majeure events. Risk in the goods passes to you once the order is handed to the shipping carrier; however, this does not affect any rights available to you under the Consumer Protection Act, 2019 in respect of goods lost or damaged in transit.
6. Returns, Refunds, and Cancellations
Returns, exchanges, refunds, and order cancellations are governed by our Refund Policy, which is designed to be consistent with the Consumer Protection (E-Commerce) Rules, 2020. Please refer to that policy for eligibility windows, condition requirements, and the refund process.
7. Intellectual Property
All content on the Services — including our brand name, logo, product designs, photography, graphics, and text — is owned by Krosso or its licensors and protected under Indian and international intellectual property law. You may use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or publicly display any material from the Services without our prior written consent. Shopify's name, logo, and related marks are trademarks of Shopify Inc.
8. Third-Party Tools and Links
The Services may link to, or integrate with, third-party websites, tools, or payment processors that we do not control. We are not responsible for the content, accuracy, or practices of any third party, and any interaction with such third parties is at your own risk. Please review the relevant third party's own terms and privacy practices before engaging with them.
9. Relationship with Shopify
KROSSO is powered by Shopify, which enables us to provide the Services to you. Any sale made through krosso.in is made directly between you and KROSSO. Shopify is not responsible for any aspect of that sale, including product quality, injury, or loss arising from it. You agree that any claim relating to your purchase must be directed to KROSSO, not Shopify.
10. Privacy
Your personal information is collected and processed in accordance with our Privacy Policy and, where applicable, Shopify's Privacy Policy. By using the Services you acknowledge that you have read and understood our Privacy Policy.
11. Feedback and Reviews
If you submit reviews, comments, or other feedback to us, you grant KROSSO a non-exclusive, worldwide, royalty-free licence to use, reproduce, and publish that content for the purpose of operating and promoting the Services. You confirm that your feedback is your own, lawful, and not defamatory, obscene, or infringing of any third party's rights. We may remove any feedback at our discretion.
12. Errors and Corrections
Occasionally the Services may contain typographical errors, or inaccuracies relating to product descriptions, pricing, or availability. We reserve the right to correct such errors and to update, change, or cancel affected orders at any time, including after an order has been placed, and will notify you if this affects your order.
13. Prohibited Use
You agree not to use the Services to: violate any applicable law; infringe our or any third party's intellectual property; harass, defame, or harm any person; transmit false, misleading, or fraudulent information; upload viruses or malicious code; scrape, crawl, or copy site content without permission; or interfere with the security or normal operation of the Services. We may suspend or terminate your access if we reasonably believe these Terms have been violated.
14. Disclaimer of Warranties
The Services and products are provided on an "as is" and "as available" basis. To the extent permitted by applicable Indian law, we do not warrant that the Services will be uninterrupted, error-free, or entirely secure. Nothing in this section limits any statutory right or remedy you have as a consumer under the Consumer Protection Act, 2019 in respect of defective goods or deficient service.
15. Limitation of Liability
To the maximum extent permitted by applicable law, KROSSO's aggregate liability arising from your use of the Services or purchase of any product shall not exceed the amount paid by you for the relevant order. We are not liable for indirect, incidental, or consequential loss arising from your use of the Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Indian law, including under the Consumer Protection Act, 2019.
16. Indemnity
You agree to indemnify and hold KROSSO, its officers, and affiliates harmless from any claim or demand, including reasonable legal costs, arising from your breach of these Terms, your violation of any law, or your misuse of the Services.
17. Severability and Waiver
If any provision of these Terms is found unenforceable under applicable law, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision will not be treated as a waiver of that right.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Services.
19. Changes to These Terms
We may update these Terms from time to time by posting the revised version on this page with an updated "Last updated" date. Material changes will be notified to you where required by law. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
